A suspected Avenues hooker who was brought to court on accusations of shoving an 18 year old boy out of her apartment and leaving him with a broken leg and arm has been acquitted.
Daina Bhutsu was yesterday cleared of attempted murder charges she was facing when she appeared before Magistrate Noel Mupeiwa. Magistrate Mupeiwa acquitted Daina citing unclear circumstances surrounding the evidence presented before the court.
Daina who was being represented by Tamuka Moyo of Takuma Moyo attorneys, had denied the charges saying the boy,Innocent Munyaradzi Sifiyalo approached her for sexual services. She also told the court that Innocent also tore her undergarments during the scuffle which ensued after the boy refused to pay for services rendered.
The Form Four Student told the court how Diana attempted to force him to have sex with her and how she kicked him out through the window.
"I went to the flat looking for Yvonne and found her seated outside along with her friend. Her friend told me that Daina would show me Yvonne's place since she knew her apartment. We went upstairs to the 3rd floor and I was in front with her following from behind. We got into her room and I was surprised to see that the person I was looking for was not inside. I then asked her where Yvonne was and she told me that she was not there. Daina told me that she was in the same trade with Yvonne and I was supposed to give her the money that I wanted to pay Yvonne and have s*x with her," he said.
Innocent also told the court that he refused and asked Daina to let him go. He told Magistrate Mupeiwa that Daina grabbed him by the collar and pushed him onto the bed. " I started making noise while I was inside the room. She then grabbed me by the collar, demanding money. I then managed to bite her on the cheek in a bid to free myself. I took a vase that was in the room and hit her on the head. We wrestled until she kicked me out of the room through the window," he said.
Innocent said that he was surprised to see himself surrounded by many people and discovered that he had broken his arm and leg.
"Someone then rushed me to the hospital," he said, although his first statement failed to satisfy the court to prove a prima facie against Daina.
Allegations that Diana faced were that on February 11 this year at around 9am Innocent Sifiyalo went to Kenedin Court searching for a girl he had met in the kombi called Yvonne. Its alleged that at the entrance, he met Bhutsu and another woman identified as Sibo at the entrance and asked them about where he could find Yvonne. The court heard that Diana told Innocent to follow her so that she could direct him to Yvonne's apartment. She then took the unsuspecting Innocent to her apartment in second floor instead where she then opened the door and asked him to enter and he obliged.
It is said that Diana locked the door and told the 18 year old that she could provide whatever he was looking forward to from Yvonne before pushing him onto the bed. The court heard that Innocent turned down her seductions as he was really keen to be in touch with Yvonne. He asked her to open the door so that he could leave but Diana got stubborn and refused to budge.
The matter quickly degenerated into a scuffle and Innocent hit the thigh vendor with an unnamed object on the forehead but the hooker blinded him with an unmitigated and unmodulated avalanche of thunderous fists.
The fiery hooker, Bhutsu, it is further alleged, battered the poor boy against the window breaking it in the process. She then pushed him out and he sustained a broken leg and arm upon landing on the ground. He was then taken to Parirenyatwa hospital for treatment.
