A MAID from Gweru was lucky to escape jail when she was sentenced to perform 420 hours of community service for fatally assaulting a 73-year-old granny in a dispute over $5.
Sithabile Moyo, 23, of Nembudziya Village in Gokwe, pleaded guilty to culpable homicide for causing the death of Esnath Mutizwa on July 17 last year at about 10AM.
The court heard how Moyo hit Mutizwa once on the chest with her right elbow and she fell face first onto a pile of logs.
She died instantly.
A postmortem report showed that she died as a result of multiple cerebral contusions and head trauma.
Moyo had earlier told Mutizwa that her grandson, Munyaradzi Mutizwa, had stolen her $5.
She appeared before Gweru Regional Magistrate Morgan Nemadire yesterday and was sentenced her to a wholly suspended five years in prison.
Moyo, who was employed in Mambo suburb, Gweru, when she committed the crime, pleaded for leniency.
“Your Worship, I’m pleading for a lighter sentence. If I go to prison no one will take care of my family in Gokwe as I’m the breadwinner,” she said.
Magistrate Nemadire chided Moyo saying such negligent behaviour was not expected from young women.
“You should learn to manage your anger as you caused the death of an innocent 73-year-old woman who in turn paid for her grandson’s deeds,” he said.
“You’ve been sentenced to five years in prison of which three years are suspended for five years on condition you do not commit a similar offence. A further two years is suspended on condition you perform 420 hours of community service at Mtapa clinic.”
