ONE of the two men who allegedly raped a prominent musician's daughter was yesterday slapped with a 20–year–jail term after he was convicted of the crime while his alleged accomplice was let off the hook as the evidence presented did not link him to the offence.
Trial magistrate Fadzai Mtombeni acquitted Sean Swanepool (23), but jailed Nathan Stotombe (26) after a full trial held in camera.
Stotombe will, however, serve an effective 17 years behind bars after three years were conditionally set aside for five years.
Mtombeni said while the 19–year–old girl just wanted to have a tattoo, Stotombe, however, decided to sexually assault her. She said only a custodial sentence would meet the justice of the case.
The court heard during trial that the two men first intoxicated her before taking turns to rape the girl before shooting photos of her while she lay unconscious in the nude and circulating them on social media.
Stotombe and Swanepool yesterday appeared before regional magistrate Mthombeni for trial.
Prosecutor Daniel Muchimbiri alleged that on July 13, the 19–year–old girl, who wanted to be tattooed, met Stotombe in the central business district.
He further told the court that Stotombe told the teenager that that the tattooing process was to be done at Swanepool's residence.
When she agreed to the deal, they allegedly boarded a commuter omnibus and went to his house. The court heard that the two left the girl seated on the veranda and went to the shops where they bought some brandy.
Upon their return, they allegedly led her to a back room where they started drawing the tattoo.
When the victim complained about the pain, they allegedly gave her brandy which they said would lessen the pain. The court heard that Stotombe kept plying her with the brandy until she passed out.
They allegedly took advantage of her drunkeness and raped her while taking photos of her naked.
The complainant was said to have gained consciousness after midnight and discovered that she was back home.
On July 17, she discovered that her pictures were circulating on social networks, showing her lying face down with her undergarments lowered.
Sitotombe allegedly featured in some of the pictures holding the complainant's backside. A police report was filed leading to the pair's arrest.
