An unlicensed killer driver who fled the scene in a hit and run accident has been slapped with a five year jail term by a Harare Magistrate on Thursday after a fully contested trial.
Chrispen Magaya (33) who is a tout in Harare was facing charges of culpable homicide, driving without a license, failing to stop after an accident and failing to report the matter.
The court was not lenient with Magaya as he has a previous conviction for driving without a license.
He was slapped with an effective five year jail term and ordered not to drive public transport again.
The State proved its case that on October 8 2018, Magaya was involved in an accident along Lomagundi Road while he had two passengers on board in the commuter omnibus he was driving.
The now deceased Joseph Munyame was standing on the white line, trying to cross Lomagundi road when he was knocked down by the over speeding Magaya.
Magaya fled the scene without rendering any assistance or calling for help to attend to the accident victim.
Munyame died on the spot due to the multiple injuries from the impact of the hit.
The two passengers who were on board, Lowani Ncube and Sandra Maravanyika noted the vehicles registration number and alerted the Harare Central police of the incident leading to Magaya’s arrest.
Avondale traffic was then informed but when they attended the scene, Munyame was already dead and they referred his body to Parirenyatwa Group of Hospitals mortuary where a post-mortem was performed.
The results showed that the cause of death was shock, lungs rapture, contusion and multiple injuries.
Magaya had pleaded not guilty to the offence.
