A SEX-STARVED Gweru man has been jailed for 12 years after he was found guilty of raping his 19-year-old cousin sister who had stitches on her bleeding privates.
The man, 28, is a Mkoba 14 suburb resident who took advantage of his mother's absence to violate the teenager as she slept in a separate room with her one-year-old daughter. He cannot not be named to protect the identity of the complainant but their mothers are sisters.
A Gweru court, which presided over the trial, heard that on January 31 this year, the man was left at home with the girl by his mother who had taken another of her children to a local clinic.
Later at around 10pm, the brother left the kitchen where he slept, entered the dining room and switched on the radio, increasing the volume. He then entered the bedroom where the teenage mother slept on the floor with her daughter.
The court further heard that the accused took the child and placed it on the bed and joined the mother in the blankets. He went on to remove his sister's clothes and had forced sex with her, ignoring her pleas to be spared as she had stitches on her privates.
After the rape, he threatened to assault and chase the sister from his mother's home if she reported the rape to anyone. She only reported the ordeal to her mother after returning to Gweru from Silobela on May 8 this year. Following a family meeting, it was agreed to report the case at Nehanda police station in Mkoba 19.
In passing sentence, Gweru regional magistrate, Morgan Nemadire said the moral blameworthiness of the brother was high in that he violated his own sister. He went on to hand down a 15 year jail sentence.
Three years were however suspended for five years on condition of good behaviour. Nemadire said the accused had caused tension in his family through his "wayward behaviour".
