Jailed RMG Independent End-Time Message founder, Robert Martin Gumbura has made another attempt to get freedom by appealing against the decision of the High Court.
Gumbura filed a Supreme Court appeal against the decision by the High Court to deny him bail pending appeal.
In the application, Gumbura through his lawyer, Advocate Thembinkosi Magwaliba is arguing the High Court erred in saying the appeal had no prospects of success.
Advocate Magwaliba challenged the decision, saying despite the High Court finding out that the magistrate did not properly analyse some of the evidence, the judge went on to deny the appeal.
He further submitted that there is no sound explanation as to why there were delays in reporting the rape to the police.
In the event that the appellant finds favour in the Supreme Court, he is willing to pay US$1000 bail and to surrender title deeds of his Marlborough property, among other bail conditions.
Gumbura was denied bail before and during his trial and soon after his conviction and sentence. He appealed against both conviction and sentence and further applied for bail pending appeal which was dismissed by Justice Joseph Musakwa on the grounds that there was no prospects of success in his appeal.
Gumbura was sentenced to an effective 40 years in prison after being convicted of raping women, among them a 16 year old girl.
