Harare businesswoman Rudo Mutambanengwe nee Boka (pictured with husband) has won US$50,000 adultery damages against Delta Beverages finance and administration manager Lorraine Chitereka, whom she had sued for carrying on an affair with her husband Noah Mutambanengwe.
High Court judge Justice Clement Phiri ruled in Boka’s favour and granted her a default judgment after Chitereka failed to defend the lawsuit.
Through her lawyer advocate Thabani Mpofu, Boka filed summons on October 26, 2018 in a bid to compel Chitereka to compensate her and, in the same order, desist from continuing the adulterous relationship with Mutambanengwe.
Despite several warnings, Boka said in her legal papers, Chitereka continued living “in open adultery as husband and wife” with Mutambanengwe who married Boka on August 8, 2015 in Harare.
After realising that Chitereka had not bothered to defend the claim, Boka again petitioned the High Court on February 19, 2019 seeking a default judgment which Justice Phiri granted in her favour.
“Whereupon after reading documents filed of record and hearing counsel, it is ordered that: defendant (Chitereka) shall pay to plaintiff (Boka) the sum of US$25 000 for contumelia, US$25 000 for loss of comfort, companionship and services of her spouse,” the judge said.
Reached for comment on the victory, the tobacco businesswoman said she was “unwilling to discuss the personal matter.”
